Accra Sky Train Case: Former GIIF Bosses Seek Bail Term Variation

The legal representatives of Prof. Christopher Ameyaw-Akumfi, the former Board Chairperson, and Solomon Asamoah, the ex-Chief Executive Officer of the Ghana Infrastructure Investment Fund (GIIF), are currently seeking an alteration to their bail conditions. The core issue revolves around the requirement for the accused to routinely report to investigators handling the 'Accra Sky Train project' case.

Both Prof. Ameyaw-Akumfi and Mr. Asamoah are facing trial at the Criminal Division of the High Court. The charges against them include allegedly causing a financial loss of $2 million to the state in connection with a proposed sky train project. They are accused of conspiracy, wilfully causing financial loss to the state, and intentionally dissipating public funds – six counts in total. Both have pleaded not guilty.

Currently, they are out on bail, collectively amounting to GH¢25 million, with the condition of providing two justified sureties. Furthermore, Prof. Ameyaw-Akumfi is obligated to report to the police weekly, while Mr. Asamoah's bail terms require him to report to the investigator every Monday, Wednesday, and Friday.

During a recent court session, their legal counsel orally requested a modification of these reporting requirements. However, Justice Comfort Tasiame, presiding over the court, instructed the lawyers to formally file their application with detailed justifications, allowing the Attorney-General to respond appropriately.

The case has been adjourned to June 24, 2025, for a Case Management Conference (CMC). During this conference, the Deputy Attorney-General and Minister of Justice, Dr. Justice Srem-Sai, is expected to withdraw certain witness statements related to the matter.

The Prosecution's Allegations

The Attorney-General has accused Mr. Asamoah and Prof. Ameyaw-Akumfi of illicitly transferring $2 million from GIIF's account to Africa Investor Holdings L. This forms the basis of the financial loss charge.

Next Steps in the Case

The upcoming Case Management Conference will be crucial in determining the future direction of the trial. The withdrawal of witness statements could significantly impact the prosecution's case. The outcome of the bail variation request will also determine the level of freedom the accused will have during the trial proceedings.
